NEW BUSINESS/Transfer Station Operating Plan
Select Board Chairman, Glenn Wiggin, announced the meeting was to review Transfer Station information. The SB discussed the status of the Town’s Operation and Closure Plans.
Recently, it has come to the attention of the SB that the Town of Stark does not have an approved Operation Plan or Closure Plan for the Transfer Station (TS) on file with the NHDES. To comply with permits through the NHDES, the Town must have both an approved Operating and Closure plan on file. Several representatives from the NHDES have provided guidance to SB Members, Glenn Wiggin & Lisa Demers, regarding meeting the requirement for permitting. Some discrepancies exist within the information provided; the SB is still seeking clarification and understanding of the requirements they must meet.
One conflicting requirement is whether a private contractor could have access to the TS when an operator is NOT present. Both Glenn Wiggin and Lisa Demers have contacted the NHDES Director and the Administrator, as well as the NHDES Compliance Supervisor, asking for clarification on this matter. The answers received conflict with one another. While the NHDES Director and Administrator say the practice of a private contractor having a key and access without an operator present is allowed, the NHDES Compliance Supervisor has stated that a hauler should not be at the TS when an operator is not present.
Many questions and conversation ensued; the SB answered all questions and listened to public comments.
Select Board Member, Jim Walsh, made a motion to start the process for Permit by Notification beginning with an Operating Plan and Closure Plan. 2nd by Lisa Demers. All 3 SB members voted in the affirmative. Motion Passed
The SB will be meeting every Tuesday to work on this process.
Jim Walsh made a motion for Normandeau Trucking to retain a TS key for access, with the understanding that TS Operator, Stephan Gilman, will be notified when they will be picking up so he, or another licensed operator, can be on site when possible. If Stephan is not available, he will reach out to other operators. If no operator is around, Normandeau Trucking can enter the TS for the purpose of hauling trash. Motion 2nd by Glenn Wiggin. All SB members voted in the affirmative. Motion Passed
Select Board Member Jim Walsh would like SB to consider fire department and road agent having keys, which could be written in the Operating Plan, if the SB decides to do so.
Jim Walsh shared research he had completed for representatives on the SB being members of the Planning Board. He also shared some information regarding criminal record checks and information allowed on employment applications. No action was taken on this information.

Lisa Demers made a motion to adjourn, 2nd by Glenn Wiggin. All SB members voted in favor.
